Many of our clients work under the provision of, or interact in some way with the Petroleum and Gas (Production and Safety) Act 20014 (QLD) and its associated regulations.
As with other legislation, the P&G Act and Regulation is constantly shifting and improving document and is refined in order to meet required application. The Land, Explosives and Other Legislation Amendment Bill 2017 (QLD) was introduced into Parliament last year however it was not passed at that time for process related reasons (dissolution of parliament for the election). It has now been reintroduced.
Below is a brief, but not exhaustive, list of some proposed amendments for our clients' consideration. More information to follow as things progress:
- Including a provision that requires the Executive Safety Manager to provide information to the Chief Inspector about Key Statutory Position Holders for the Operating Plant
- Removal of any time limit for a proceeding after the offence first comes to the notice of the complainant.
- Inclusion of a provision so that if a person has not been appointed as Site Safety Manager (SSM), the Operator (if an individual) or Executive Safety Manager (If a corporation) will become the default SSM.
- Inserting an obligation for the Executive Safety Manager to nominate an operator representative if the operator of operating plant is a corporation.
